Pension Funds Sue Bayer for Hiding Risks of Yaz

According to an article on Bloomberg.com, a lawsuit has been filed against drugmaker, Bayer AG, alleging that the company misrepresented the effectiveness and safety of the Yaz contraceptive to increase sales.

In a federal complaint made public in Philadelphia, two pension funds for firefighters and city employees have stated that Bayer unlawfully promoted Yaz from March 2006 to March 2009 by hiding the side effects linked to the drug.

These harmful side effects include blood clots, heart attack, deep vein thrombosis, pulmonary embolism, liver failure and kidney failure.
This contraceptive was Bayer’s top selling drug last year with about $1.8 billion being brought in for the company. Women have been coming forward recently complaining about side effects that they have allegedly suffered from Yaz and Yasmin.

According to the Bloomberg.com article, it is estimated that 300 cases have been filed against Bayer for Yaz. Bayer spokeswomen Marcy Funk was quoted as saying, “we’re not aware of 300 cases being served. As of September 24, Bayer has been served in 74 cases.”

The complaints allege that women who took Yaz may have suffered strokes, heart attacks, gallbladder disease and sudden death. Yaz contains an ingredient, known as drospirenone, which may increase blood potassium levels. This ingredient is not found in most contraceptives in the United States.

The plaintiffs claim that Bayer downplayed the risks associated with taking Yaz when it marketed the drug. The complaint said that television commercials “misleadingly and deceptively” promoted the drug for uses that were not approved by the U.S. Food and Drug Administration.
